General Damages

Claim compensation for injuries, pain, suffering, loss of amenity

"General damages" is the legal term used for the compensation that is paid for physical injuries, pain, suffering and loss of amenity. Accident injuries vary in each individual case. Our panel of specialist solicitors act for clients with injuries ranging from minor whiplash injuries to fractures to severe spinal cord and head injuries. It is also possible to claim compensation for psychological injuries such as depression, or post traumatic stress disorder (PTSD).

General damages are difficult to assess as some monetary value has to be placed on the pain and suffering you've gone through, possible future loss of earnings, loss of amenity, and how your lifestyle may be affected by your injury or injuries in the future. Levels of general damages compensation awards differ as each case takes into account its own variables.

As part of the investigations into your general damages claim, your appointed solicitor may instruct a medical expert to produce a written report on your injuries. This evidence will be used to assess the value of your injury claim. The courts assess how serious the injury is, how it has affected your lifestyle, and whether there is any permanent disability, before deciding how much it is worth. The courts use previous cases involving similar injuries as guidelines for valuing compensation awards.
